CLARIFICATION TEXT ON THE PROCESSING OF PERSONAL DATA EMPLOYEE / EMPLOYEE CANDIDATE / INTERN
a) Data Controller
As GEMA ELEKTRO PLASTİK VE ELEKTRONİK SAN. DIŞ TİC. A.Ş. (hereinafter referred to as "Company 1") and GEMA POLİMER PLASTİK ÜRÜNLERİ SANAYİ VE TİCARET ANONİM ŞİRKETİ (hereinafter referred to as "Company 2"), we respect and attach importance to the privacy of private life. For this reason, we would like to inform you about your rights regarding the use and protection of your personal data that we process in the capacity of data controller within the scope of the Law numbered 6698 on the Protection of Personal Data (hereinafter referred to as "KVKK").
Company 1 and Company 2 will be collectively referred to as "COMPANIES" in this clarification text.
b) Processed Personal Data
The categories and descriptions of personal data to be processed within the scope of the purposes and legal reasons specified in this Employee Candidate Clarification Text in accordance with the KVKK and other relevant legislation are as follows:

Other |
Military service status, cover letter, certificates, hobbies and competences, driving license information that may form an opinion about your personal and managerial skills that you have stated in your resume, Reference information (name-surname, telephone, e-mail, title,) |
Apart from the specified categories, we also process your personal data that you submit through your resume that you upload manually during resume creation by saving it in your resume. In this context, we recommend that you do not enter personal data that you do not prefer to be processed in our system in the fields filled in manually.
c) For Which Purposes Personal Data Will Be Processed
Your personal data will be processed for the purposes of;
- Managing employee/intern candidate selection and placement processes,
- Carrying out the application processes of employee/intern candidates,
- Planning of human resources processes,
- Carrying out communication activities,
- Follow-up and execution of legal affairs,
Will be processed within the ;"c) Provided that it is directly related to the establishment or performance of a contract, it is necessary to process personal data belonging to the parties to the contract" specified in Article 5 (2) (c) of the KVKK.
Your special categories of personal data that you submit in your resume will be processed for the purposes specified in this article within the legal reason "it is prohibited to process special categories of personal data without the explicit consent of the person concerned" specified in Article 6 (2) of the KVKK.
d) Method and Legal Grounds for Collection of Personal Data
In order to fulfil the purposes set out in paragraph (c) of this text, your personal data will be obtained electronically by you by filling in the application form and uploading your resume, based on the legal grounds set out in Articles 5 (2) and 6 (2) of the KVKK.
e) Transfer Abroad
Your personal data processed on the basis of the legal grounds specified in Article 5 (2) of the KVKK, without obtaining the explicit consent of the person concerned, in line with the conditions for transfer abroad in Article 9 (2) of the KVKK, since the transactions related to payrolling are carried out through online software systems whose databases are abroad,
(i) Foreign countries declared to have adequate protection by the Personal Data Protection Board (hereinafter referred to as the "Board") ("Foreign Country with Adequate Protection") or
(ii) Provided that it is limited to the foreign country and/or countries where the data controllers in Turkey and the relevant foreign country undertake in writing an adequate protection and where the Board has authorised the relevant transfer ("Foreign Country Where the Data Controller Undertakes Adequate Protection")
can be transferred.
The transfer of your personal data processed within the scope of the purposes described above will be carried out by our Company in accordance with the decisions taken by the Board and the relevant regulations, in particular the KVKK and other relevant legislation, by taking all necessary care and taking all necessary security measures.
f) Your Rights under Article 11 of KVKK
Within the scope of Article 11 of the KVKK, you have rights as a data subject and you can submit your requests regarding these rights by filling in all the information specified in the Data Subject Application Form in accordance with Article 11 and paragraph 1 of Article 13 of the KVKK and the Communiqué on the Procedures and Principles of Application to the Data Controller,

g) Retention Period of Personal Data
Our companies delete, destroy, annihilate or anonymize personal data upon the expiration of the mandatory retention periods determined within the scope of the Laws and other relevant legislation, as well as the disappearance of the purpose of processing personal data.
h) Amendments and Updates
This clarification text has been prepared within the scope of the Law No. 6698 on the Protection of Personal Data and other relevant legislation. Necessary amendments may be made in the said clarification text in line with the relevant legal legislation and / or amendments to the personal data processing purposes and policies of the Companies.
